Article 370 to be scrapped, J&K to be bifurcated

Article 370, which accords special status to J&K, has been removed, Amit Shah told Rajya Sabha. The government also moved a bill proposing bifurcation of J&K.

Articel 370

Mr. Amit Shah, the Home Minister of India, has introduced a Bill to remove Article 370 of the Constitution of India along with the Reservation Bill. Article 370 provides for the special status to Jammu and Kashmir.

Mr. Amit Shah also proposed to introduce the bill for re-organisation of Jammu and Kashmir. It is proposed to make Jammu & Kashmir a Union Territory with Legislature and Ladakh a Union Territory without Legislature.

After Amit Shah proposed that the regulation under Article 370 will not be applicable after Presidential nod, the Rajya Sabha witnessed massive uproar with the Opposition slamming the Centre over the move.

The President of India has also issued a presidential order “The Constitution (Application to Jammu and Kashmir) Order, 2019” in exercise of the powers conferred by clause (1) of article 370 of the Constitution, with the concurrence of the Government of State of Jammu and Kashmir.

This order will supersede the Constitution (Application to Jammu and Kashmir) Order, 1954 by which special status had been given to Jammu and Kashmir.
